DMCA Notices on Offshore Servers: A Checklist | RedoubtHost

What to do when a copyright notice hits an offshore VPS — classify, verify, respond, backup, and work with your host without fantasy.

Copyright notices still arrive on non-US servers. Offshore changes incentives; it does not delete copyright or guarantee every notice is ignored. This checklist is for operators who respond like adults.

Not legal advice.

What a “notice” might be

  • Formal DMCA-style notice aimed at a US provider
  • Local copyright complaint
  • Upstream ticket forwarded down
  • Automated scan with partial URLs
  • Trademark complaint mislabeled as DMCA

Before you ever get one

  1. Off-site backups with a tested restore
  2. Rights inventory (own / license / exception)
  3. Abuse email you actually read
  4. Host process pages read at purchase — policy, money page
  5. DNS you control; low TTL when risk is high

First hour

  1. Do not rage-post
  2. Save headers and body
  3. Map exact paths
  4. Confirm control of the content
  5. If UGC, identify uploader and your rules
  6. Brief stakeholders with facts

Validity checks

  • Work identified?
  • Location specific enough?
  • Complainant identifiable?
  • Your origin vs CDN you do not control?

Response options

  • Remove/disable when appropriate
  • Replace with licensed material
  • Dispute with counsel when stakes are high
  • Do not “ignore forever” while upstream threatens the pool

Working with your host

  • Ticket IDs and exact paths
  • Good faith on third-party UGC
  • No threats to staff
  • Ask the upstream deadline
  • Say early if you need counsel time

What not to do

  • Hop bulletproof hosts as a business model for the same infringing library
  • Assume crypto = unfindable
  • Delete evidence you may need (within lawful retention)

Evidence pack

Store notice files, reply timestamps, screenshots, CMS history, licenses, and relevant access logs by ticket ID. Reconstructing history under pressure is how mistakes happen.

Caches

Purge CDN edges after origin removal and document purge IDs. Search caches are separate from you continuing to host a file.

  1. Acknowledge receipt + reference
  2. What you found on the path
  3. What you did
  4. When you will update next if work remains
  5. Ask if anything else is required

Clarity shortens escalations. Hostility lengthens them.

Roles: who does what

  • You: content decisions, rights records, app moderation
  • Host: infrastructure AUP, ticket process, upstream relationship
  • Counsel: high-stakes disputes and legal strategy
  • CDN/registrar: separate contracts, separate tickets

Confusion about roles is how deadlines are missed.

First-hour discipline

Do not delete logs in panic. Do not publicly escalate before you understand the claim. Do not ignore upstream deadlines while drafting the perfect essay. Capture evidence, classify, act, communicate.

UGC-specific notes

If users upload, map notice URLs to object IDs quickly. Keep a license vault. Rate-limit public upload endpoints. Schedule quarterly drills: pick a random asset and prove you still have rights documentation.

Caches and CDNs

Origin removal without edge purge looks like non-compliance. Know who can purge and how. Document purge IDs in the ticket thread.

When to involve counsel

High damages claims, unclear fair-use situations, government process, or repeated sophisticated complainants. Hosting tickets are not a substitute for legal strategy.

After action

Write a three-bullet internal note: root cause, user impact, prevention. Abuse returns if you only clear symptoms.

Calm communication beats clever rhetoric

Hosts escalate faster when customers ghost them or reply with threats. A short factual update every day during an open ticket is better than silence followed by a novel. If you need time for counsel, say when the next human update will arrive.

Prevention beats reaction

Most painful notice events are predictable: open uploads, abandoned plugins, unclear licenses, no backups. Fix those before you need this checklist. Infrastructure choice amplifies good process; it does not replace it.

One-page wallet card for on-call

1) Save notice. 2) Map paths. 3) Preserve logs. 4) Classify. 5) Act on origin+CDN. 6) Reply with facts. 7) Schedule postmortem. Keep this list where on-call can see it without searching a wiki under stress.
